Toohil’s Diabetic Shoe Bill Approved by Committee, Heads to House Floor
HARRISBURG – Legislation sponsored by Rep. Tarah Toohil (R-Luzerne), that would remove fitters of diabetic shoes and inserts from requiring state licensure, was unanimously approved by the House Health Committee today. House Bill 2242 will next be considered by the full House of Representatives.

Toohil’s bill would amend the Medical Practice Act of 1985 to exempt pharmacists, appropriately trained pharmacy personnel or durable medical equipment (DME) provider personnel from licensure requirements with respect to the fitting and patient management of off-the-shelf therapeutic diabetic shoes and inserts. This exemption will allow pharmacies and DME providers to continue to dispense diabetic shoes with manufacturer’s training. The exemption would apply only to those individuals currently fitting the devices.

“There is an unintentional situation created by current law that will take place soon regarding fitters of diabetic shoes,” said Toohil. “As of July 2014, they will be prevented from doing their job unless they are certified specifically as licensed orthotic fitters. My legislation will allow them to continue to sell these specialized products without going through extensive licensure qualifications.”

Toohil pointed out that DME providers and pharmacies currently account for nearly 95 percent of sales of these devices.

“If the issue is not addressed, patients in Pennsylvania will be limited to getting their diabetic shoes from a small number of licensed pedorthists spread across the state, resulting in restricted access to care,” said Toohil.

House Bill 2242 also removes the licensure requirement for fitters of post-mastectomy products.
